    PERM Labor Certification

    For most professional and skilled worker employment-based green card applications, the first step is to show that both the job and the employee qualify for sponsorship. The purpose of the PERM Labor Certification process is for an employer to demonstrate that there are no qualified and available US workers to fill a position. A number or required recruitment efforts and postings must be completed per strict rules.

    Employment-based Permanent Residence

    An employer may sponsor a worker to take a permanent job in the US by filing a petition with USCIS. The worker then either applies to adjust status within the US or obtain an immigrant visa from a US Consulate abroad. The employment-based system prioritizes individuals who will provide the most benefit the US economy. In some cases, the employer must complete a labor market test.

    US citizens and permanent residents can sponsor their relatives for permanent residence in the US. A number of legal requirements must be met.

    E-1 and E-2 Visas

    These visas facilitate trade (E-1) with and investment (E-2( into the United States by nationals of countries that have a treaty with the US. The trade must be significant or a substantial investment should be with a new or active business that contributes to the US economy and local labor market. These visas are ideal for entrepreneurs, startups, as well as established corporations.

    H-1B1 Singapore & Chile

    The E-3 visa for Australians and the H-1B1 visa for Singaporeans and Chileans allow US employers to hire highly educated and skilled professional employees in the United States. The offered job must be one that normally requires a minimum of a bachelor’s degree. The employer must pay at least the prevailing wage.

    H-1B Visa

    The H-1B visa allows US employers to hire highly educated and skilled professional employees in the United States. The proposed role must qualify as a “specialty occupation”, which is a job that normally requires a minimum of a bachelor’s degree. Pay must exceed the prevailing wage. There is a limited supply of these visas and subject to a random lottery system.

    L-1 Visas

    The L-1 visa allows companies to transfer key managers, executives and specialists from a related company abroad to the US. The employee must have been employed for at least one year in the past three years with a qualifying affiliate company abroad.

    O-1/2 Visas

    The O-1 visa is for individuals who have extraordinary ability in the sciences, arts, education, business, or athletics. Individuals who are coming solely to assist in the artistic or athletic performance by an O-1 may be granted O-2 visas.

    P-1/2/3 Visas

    The P-1 visas is for top athletes coming to the US to compete individually or as part of a team, as well as members of renowned entertainment groups. P-2 is for artists and entertainers under a reciprocal exchange program. P-3 is used to perform, teach, or coach in a culturally unique program.
